Letter of Apology: About Auldey and L3,to YYF&DIF
« on: January 03, 2009, 11:36:23 PM »

Hi Everyone,
I am Luo Yi-Cheng, the designer of the L3. I am concern about the hubstack and KonKave bearing problem in L3.
The design of L3 was sold to Auldey just to get me sponsored for Worlds 08. My idea was to construct a very fast yo-yo with high controlliability during the designing process. I was not sure if Yoyofactory have patent on hubstack and Dif-e-yo on KonKave bearing. Auldey told me that both companies have no patented article in China, and L3 was planned to be sold in China only. As a result, I applied both hubstack and KonKave bearing on L3.
Currently, L3 have flowed to US under private trades. I deeply apologize if L3 has offended Yoyofactory and Dif-e-yo. In my next yo-yo, I will not apply both hubstack and KonKave bearing.
L3 is now a product of Auldey. I'm just a designer and player,I have no relation with Auldey's production and marketing,so I'm helpless regard to Auldey’s marketing and advertisements. Please bear with L3’s low price and its availability to international players.

Thanks Anson for helping to translate!

I like mine better without the hubstacks it plays so much faster with better control. Thank you for designing such a great yoyo takuto!

maybe you should make an L4 and sell the design to YYF!

that would be the awesomeness.

Just out of curiosity, was Takuto's L2 created before or after YYF's 888?

According to yoyowiki.org, Takuto's L2 with "side bearing caps" was released at AP on December 15th, 2006, while the G5, with it's hubstacks, was released on December 25th, 2006.

(And of course there was the Miroc before either, but that's a whole different kettle of fish.)

I am by no means anything resembling a lawyer, and there are certainly differences between the two designs (with the L2's caps being metal) but this seems like at least a bit of prior art.

From moral standpoint, at least, it seems reasonable for Takuto to continue using a design he came up with before YYF released their version?

Ben, if I've got something wrong here I apologize in advance and invite you to correct me. I'll also openly admit I don't have experience with all the yoyos I've mentioned, so I'd be glad to hear on how YYF improved on the earlier designs.

Full props to both Takuto and YYF for being such kind, cooperative, and respectful folks.

The not being a lawyer thing is pretty obvious by your reference of a wiki. Do you think that wiki material would hold up (or even be admissable) in court? Grin Hell i could go in there right now and hcang ethe date on the L3 to December 15th, 1906 Grin

Im not doubting that those dates are correct, im just saying that any lawyer fresh out of law school could discredit wiki info with one easy question.

No intent of flaming here, just point out the reliability of your source.

Indeed! That's why I started my post with this question:

Just out of curiosity, was Takuto's L2 created before or after YYF's 888?

I provided the one information source that was lazily available to me, and was hoping someone could confirm or give more information.

I can confirm that the L2 came out -sometime- around then because I played one that Dimi got at AP '06, and I bought one at Spingear in May 07.

Cheers,
Reed.

Right. But they were both designed by the same guy.

My point is this:

If Person A makes a yoyo with a special feature,
And then Person B makes a yoyo with a similar feature a few weeks later, and takes out a patent,
Doesn't it seem at least morally fair that Person A can continue to make yoyos with the special feature he came up with first, and on his own?

Takuto has been a stand-up gentleman in issuing this apology, and Ben / YYF has been really cool about it too.

But it makes me a little bit sad that Takuto has to apologize and stop using a feature he helped innovate.

technically the l2 wouldn't be breaking the patent at all because it didn't have orings, but a clip.

Ok, so that's the main thing going on? Takuto switched from a clip retainer on the L2 to a rubber o-ring retainer on the L3?

I funny thing it that not alot people really do much with hubstacks. I even see alot of people using nubs and removing the stacks alltogether. Nick (cant rember his last name) has some cool 5a stuff he does with hubstacks but you dont see even the YYF players doing much with it in freestyles.

I remember someone posting about how there arent really many innovative hubstack tricks out there and ben replying that it is his job to come up with innovative products, Its up to the community and player to innovate tricks with the technology he creates.

It really not like we are talking about an indispensible cutting edge technology (like axle bearings) that unless you have it in your yoyo design, it will not sell. You just dont see too many fixed or transaxle yoyos on the market today.
